Reminder: Protect Your Practice from COVID-19 Lawsuits
Thanks to GCA lobbyist Aubrey Villines, doctors of chiropractic were included in S.B. 359, that protects healthcare providers and businesses from COVID-19 lawsuits except in cases of gross negligence, willful and wanton misconduct, reckless infliction of harm or intentional infliction of harm.

To ensure you are protected, you must make patients aware of the law by posting at a point of entry to the premises, a sign in at least one-inch Arial font placed apart from any other text, a written warning stating the following:

"Warning: Under Georgia law, there is no liability for an injury or death of an individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You are assuming this risk by entering these premises."
Additionally, you should follow the guidance presented by Gov. Brian Kemp for critical infrastructure including wearing and providing PPE, increased sanitation, screening employees etc. Failure to do so could provide rebuttal evidence to a potential claimant.
